These Terms of Service (“Terms”) apply to all orders, contracts, deliveries, and services made through the online store qms-schoenheits-lounge.com. The online store is operated by QMS Schönheits Lounge, Marisca Kugler, Münchener Str. 49, 85051 Ingolstadt, Germany (“we”, “us”, “our”). We sell premium cosmetic products, in particular products by QMS Medicosmetics and Mesoestetics, as an authorized reseller. We are not the manufacturer of the products offered. Information regarding ingredients, use, compatibility, and product effects is based on manufacturer information and does not replace medical advice.
These Terms apply to consumers within the meaning of Section 13 of the German Civil Code (BGB) and, where expressly agreed, to entrepreneurs within the meaning of Section 14 BGB. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.
Scope and contract language
These Terms apply exclusively to all orders placed through our online store in the version valid at the time of the order. Deviating terms of the customer shall not apply unless we expressly agree to them in text form.
The contract language is English. Where content on this website is also displayed in another language, the English version shall prevail in case of doubt.
You may access, save, and print these Terms at any time on this website.

We are an authorized reseller for selected branded products. Trademark rights, product names, images, and manufacturer information remain the property of their respective rights holders.
Offers, product presentation, and contract conclusion
The presentation of products in the online store does not constitute a legally binding offer, but an invitation to place an order.
You may first place products in the shopping cart without obligation and correct your entries at any time before submitting the binding order. By clicking the button that completes the purchase, you submit a binding offer to purchase the goods contained in the shopping cart.
Immediately after submitting the order, you will receive an automatic order confirmation by email. This confirmation merely documents receipt of your order and does not constitute acceptance of your offer unless acceptance is expressly declared in it. The contract is concluded when we accept your order, in particular by sending a dispatch confirmation, providing the goods, or issuing an express declaration of acceptance.
We reserve the right to refuse orders if products are unavailable, payment or delivery information appears implausible, there is suspicion of commercial resale without a corresponding agreement, or legal reasons prevent delivery.
Prices, taxes, and shipping costs
All prices are stated in euros and include the applicable statutory value-added tax, where applicable.
Any additional shipping costs will be shown separately during the order process before you submit your binding order.
The price applicable at the time of the order is decisive. Price changes after conclusion of the contract do not affect orders already accepted.
Payment
The payment methods available in the online store are displayed during the order process. Depending on the payment method, payment service providers may be involved in processing the payment. The terms of the respective payment service provider may also apply.
Unless a different payment period is specified during the order process, the purchase price is due upon conclusion of the contract.
In the event of chargebacks, failed payments, or unauthorized payment reversals, we reserve the right to claim reasonable costs incurred as a result, provided that you are responsible for the cause.
Delivery, availability, and partial deliveries
Delivery is made to the delivery address provided by you within the delivery areas shown in the online store. Delivery times are stated during the order process or on the respective product page.
If individual products are temporarily unavailable, we will inform you without delay. Payments already made will be refunded without delay in the event of non-acceptance or reversal of the order.
Partial deliveries are permitted where reasonable for you. Additional shipping costs will only arise if expressly agreed.
For consumers, the risk of accidental loss and accidental deterioration of the goods passes only when the goods are handed over to the consumer or to a person authorized by the consumer to receive them.
Retention of title
The goods remain our property until full payment has been made.
For entrepreneurs, the following also applies: We retain title to the goods until all claims arising from an ongoing business relationship have been settled in full.
Right of withdrawal for consumers
Consumers generally have a statutory right of withdrawal. Details are set out in the withdrawal policy, which is available in the online store and provided to you in connection with the order.
The right of withdrawal does not exist or may expire prematurely where statutory exclusions apply. This applies in particular to sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
For cosmetic products, skincare products, serums, creams, ampoules, masks, peels, make-up, applicators, and comparable hygiene items, return may therefore be excluded if the protective seal, hygiene film, original seal, or comparable safety packaging has been opened, removed, or damaged.
Your statutory warranty rights remain unaffected regardless of the right of withdrawal.
Returns and cosmetic hygiene standards
Please return goods only in accordance with the return information provided in the online store. Returns must be packaged so that the goods are adequately protected.
Cosmetic products are subject to special hygiene requirements. Opened, used, contaminated, damaged, or no longer originally sealed cosmetic products may be excluded from return for reasons of health protection and hygiene to the extent permitted by law.
We reserve the right to inspect returned products. A refund may be refused or reasonably reduced if a loss in value is due to handling of the goods that was not necessary to inspect their nature, characteristics, and functioning.
Please note that product samples, gifts with purchase, free items, and promotional items must also be returned where this is required for complete reversal of the transaction or expressly requested.
Product information, use, and compatibility
Our product descriptions are prepared with the greatest possible care. Information regarding ingredients, application instructions, skin types, product effects, studies, results, or recommendations is based in particular on manufacturer information and general cosmetic experience.
Cosmetic products are not intended to diagnose, treat, cure, or prevent diseases. Our content does not constitute medical advice and does not replace advice from physicians, pharmacists, or other medical professionals.
If you have known allergies, intolerances, are pregnant or breastfeeding, have skin conditions, are undergoing medical treatment, take medication, or have particularly sensitive skin, we recommend seeking medical advice before use and carefully checking the ingredient list.
The compatibility of cosmetic products may vary from person to person. Application instructions, warnings, shelf-life information, and manufacturer recommendations on packaging and accompanying information must be observed.
Vouchers, discount codes, and promotions
Vouchers, discount codes, and promotional offers apply only under the conditions stated in each case. Combining several promotions is only possible if expressly stated.
Discount codes may be limited by time, product, brand, customer group, or quantity. Cash payment is excluded.
We reserve the right to change or end promotions for future orders, provided that already concluded contracts remain unaffected.
Defects liability and warranty
The statutory rights regarding defects apply.
Please inspect the delivered goods after receipt and notify us of any visible transport damage as soon as possible. Failure to provide such notification has no effect on statutory claims for consumers, but helps us assert claims against shipping service providers.
For entrepreneurs, warranty rights require that they have properly complied with their statutory inspection and notification obligations under Section 377 of the German Commercial Code (HGB), where that provision applies.
Manufacturer guarantees exist only if expressly stated by the manufacturer or by us. Statutory warranty rights are not restricted by any guarantees.
Liability
We are fully liable for damages arising from injury to life, body, or health, for damages caused by intentional or grossly negligent breach of duty, for claims under the German Product Liability Act, and in all cases of mandatory statutory liability.
In the event of slightly negligent breach of essential contractual obligations, we are liable only for the typical, foreseeable damage. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance you may regularly rely.
Otherwise, liability for damages caused by slight negligence is excluded.
The above limitations of liability also apply for the benefit of our legal representatives, employees, and vicarious agents.
Customer account and access data
If you create a customer account, you are obliged to provide truthful and complete information and to keep your access data confidential.
You are responsible for ensuring that no unauthorized access to your customer account occurs. Please inform us immediately if you suspect that your access data has been misused.
We may block or delete customer accounts if there is a legitimate reason, in particular in cases of misuse, security risks, or material breaches of contract.
Privacy
The processing of personal data is carried out in accordance with our privacy policy. There, we inform you in particular about the type, scope, purposes, and legal bases of data processing as well as about your rights as a data subject.
Where payment, shipping, shop, or analytics service providers are used, this is done in compliance with statutory data protection requirements and in accordance with the respective privacy notices.
Content and trademark rights
All content on this website, in particular texts, photographs, graphics, product presentations, logos, layouts, and designs, is protected by copyright, trademark law, or other rights.
Use, reproduction, editing, publication, or distribution without the prior consent of the respective rights holder is not permitted unless allowed by law.
The brands mentioned on this website, in particular QMS Medicosmetics and Mesoestetics, are trademarks of their respective rights holders. Our use is made in the context of authorized distribution and product presentation.
Dispute resolution
The European Commission provides a platform for online dispute resolution. Consumers may obtain information about online dispute resolution options through the official information services of the European Union.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless a statutory obligation exists.
Applicable law and place of jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection of mandatory provisions of the law of the country in which the consumer has their habitual residence.
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships with us is our place of business, to the extent permitted by law.
Final provisions and changes
Should individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
We reserve the right to amend these Terms for future orders where legal, technical, or business changes make this necessary. For contracts already concluded, the version applicable at the time of the order shall apply.
